SMS/ Text Message Terms of Service

1. Program Description

Susttainability Inc (“we,” “us,” “our”) uses SMS/text messaging to communicate with customers and business contacts in connection with ongoing projects, material trials, meeting coordination, scheduling, account updates, and general business correspondence (the “Program”). By opting in to this Program, you agree to these SMS Terms of Service (“Terms”).

This Program is used strictly for transactional and conversational business communications. We do NOT use SMS for marketing, advertising, or promotional purposes.

2. Consent & Opt-In

By providing your mobile phone number through our website, a web form, email communication, or directly to a Susttainability Inc representative, you expressly consent to receive recurring SMS/text messages from Susttainability Inc at the mobile number you provided. These messages will be related to your business interactions with us, including but not limited to meeting confirmations, scheduling updates, material trial status, project coordination, and other account-related communications.

Consent is not a condition of purchase or any other business obligation. You do not need to opt in to SMS messaging to engage in any business relationship with us.

By opting in, you confirm that you are the account holder or authorized user of the mobile number provided, that you are at least 18 years of age, and that you agree to these Terms and our Privacy Policy.

3. Types of Messages

Messages you may receive as part of this Program include:

• Material trial status updates and coordination

4. Message Frequency

Message frequency varies. The number of messages you receive depends on your level of engagement and active projects with Susttainability Inc. Messages are sent only as needed in connection with your business interactions with us and are not sent on a fixed schedule.

Message and data   rates may apply. Please consult your wireless carrier’s pricing   plan for details. Susttainability Inc is not responsible for any charges   incurred from your wireless carrier.

6. How to Opt Out

You may opt out of receiving SMS messages at any time by texting STOP to the number from which you received the message. After sending STOP, you will receive a one-time confirmation message confirming your opt-out. No further messages will be sent unless you re-subscribe.

You may also request to opt out by contacting us directly via email or phone. Opting out of SMS will not affect your business relationship with Susttainability Inc; we will continue to communicate with you through other channels such as email or phone calls.

8. Supported Carriers

Our Program is supported on most major U.S. wireless carriers, including but not limited to AT&T, Verizon Wireless, T-Mobile, and others. Carriers are not liable for delayed or undelivered messages. Service availability may vary based on carrier, coverage area, and device capabilities.

9. Privacy & Data Use

We respect your privacy. Information collected through the Program (including your phone number) will be used solely for the purposes of facilitating business communications and administering the Program as described in our Privacy Policy, available at https://susttainability.com/privacy-policy

We will not sell, rent, or share your mobile number or any personal information collected through this Program with third parties for marketing or promotional purposes. We may share information with service providers who assist us in delivering messages (such as our telecommunications platform provider), but only as necessary to operate the Program and subject to appropriate confidentiality and data protection obligations.

No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. All other categories of information collected exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.

10. Disclaimer of Warranties

The Program is provided on an “as is” and “as available” basis. We make no warranties, express or implied, regarding the reliability, timeliness, accuracy, or completeness of any messages sent through the Program. We are not responsible for any delays, failures, or interruptions in the delivery of any SMS messages, regardless of the cause.

11. Limitation of Liability

To the fullest extent permitted by law, Susttainability Inc, its officers, directors, employees, agents, and affiliates shall not be liable for any damages, losses, or expenses arising out of or related to your participation in the Program, including but not limited to direct, indirect, incidental, consequential, special, or punitive damages.

12. Modifications to Terms

We reserve the right to modify or discontinue the Program or these Terms at any time, with or without notice. Your continued participation in the Program after any changes constitutes your acceptance of the revised Terms. Material changes will be communicated via the Program or our website.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Tennessee, without regard to its conflict-of-laws principles. Any disputes arising under these Terms shall be resolved in the courts located in Hamilton County, Tennessee.

14. Compliance

This Program is administered in compliance with applicable federal and state laws, including the Telephone Consumer Protection Act (TCPA), the Cellular Telecommunications Industry Association (CTIA) guidelines, and all applicable wireless carrier requirements for Application-to-Person (A2P) messaging.
